State Nomination

State nomination is a vital migration pathway enabling Australian state governments to nominate highly skilled migrants to address specific skills shortages within each state. This nomination can significantly assist skilled migrants in qualifying for a skilled migration visa from the Australian Government Department of Home Affairs by providing additional points toward their visa application. There are two skilled migration visa options available for state nomination: the Skilled Nominated (Permanent) visa (Subclass 190) and the Skilled Work Regional (Provisional) visa (Subclass 491). South Australia State Nomination Requirements for Skilled Migrants

South Australia is centrally located on mainland Australia and the state offers a relaxed, safe, family-friendly lifestyle where you can achieve true work-life balance. The state is recognized for its migrant-friendly policies, providing multiple pathways to state nomination. Unlike some other states, South Australia allocates nominations on a first-come-first-served basis rather than through a point-based ranking system.

There are four key streams through which skilled migrants can seek state nomination:

 

  1. South Australian Graduates Stream:
    This stream offers state nomination pathways for international graduates who studied in South Australia. To be eligible, applicants must meet key criteria such as living and working in South Australia, being under 45 years of age, having a positive skills assessment, scoring at least 65 points on the points test, and fulfilling specific study and work requirements. Invitations to apply are based on various factors, including visa status and employment in priority sectors.

  2. Working in South Australia Stream:
    This stream is designed for skilled migrants holding a temporary visa who are currently living in South Australia and working in their nominated occupation. To be eligible, applicants must have a valid skills assessment, be under 45 years old, have at least Competent English (unless exempt), score at least 65 points on the Department of Home Affairs’ points test, and have resided in South Australia for at least 12 months. They must also have been employed full-time in their nominated occupation for the last six months. Invitations to apply for nomination will be issued throughout the year based on various prioritization factors, including occupation demand and sector priorities like Health, Trades, Digital Technology, and more.

  3. Highly Skilled Talent Stream:
    This stream provides a pathway for highly skilled migrants to contribute their talents and support innovation in the state. This stream is opened to individuals who can demonstrate their ability to bring new ideas and skills to critical priority sectors of South Australia’s economy, regardless of where they are living in. Eligible applicants must be under 45 years old, have a positive skills assessment for their nominated occupation, and score at least 65 points on the Department of Home Affairs’ points test. They must also meet specific criteria depending on their industry experience.

  4. Offshore Stream:
    This stream provides a pathway for skilled migrants who are currently residing offshore. The candidates will be assessed on a case-by-case basis based on merit by: the years and field of skilled employment, your English language ability, and your EOI points. If you are a highly skilled migrant currently living offshore, you may also be eligible to register your interest in state nomination through the Highly Skilled and Talented Stream.

To apply for this visa you must have a nomination from the Government of South Australia and meet all nomination requirements, as well as the Department of Home Affairs eligibility criteria.

To qualify for a South Australian state nomination, there are some key requirements that you must meet.

  1. Residency Requirement

    1.1 State nomination is provided to skilled migrants who are intending to live and work in South Australia with a view to long-term settlement. This is very important to South Australian Case officer is to check your genuinity of settling down.

    1.2 If you are located offshore, there are 2 pathways for you through Highly Skilled and Talented stream and Offshore stream.

  2. Age

    You must be under age of 45 at time of nomination

  3. Occupation

    You must have an occupation on South Australia’s Skilled Occupation list and meet the eligibility requirement to each occupation. Occupations are not determined by a particular title of your job, it can be varied and you have more than one options for state nomination submission.

  4. Skill Assessment

    you MUST have a valid and positive Skill Assessment from the relevant authority within 3 years from the application date and Skill Assessment must be for your nominated occupation. Each occupation has their own skill assessing authority, please refer to Department of Home Affair website for more information on Skill Assessments.

  5. Work Experience

    5.1 Each Occupation has their own employment requirement, please refer to South Australia’s Skilled Occupation List for specific requirement of your occupation.

    Generally, skilled work experience must be undertaken post-course completion and is defined as a minimum of 20 hours per week or 40 hours per fortnight of paid employment in your nominated or closely related occupation (But if you apply 190 visa through SA graduate stream, long-term resident SA stream and outer regional SA stream, you must have 30 hours per week or 60 hours per fortnight.).

    5.2 For South Australian work experience, the employer must have a demonstrable presence in South Australia. Where the employer is located outside of South Australia, applicants must apply though the Talent and Innovator program. Work experience performed at a residential address or shared office space for a company located outside of South Australia will be assessed on a case by case basis. 

  6. English

    Each occupation or each skilled migration stream will require different English level from the minimum requirement at Competent English (IELTS 6.0 all band and Overall or Equivalent) up to Superior English (IELTS 8.0 or equivalent).

    In general, if you are working in South Australia, you are required to have at least Competent English unless further requirements in your particular occupation.

Northern Territory Graduates 190 State Sponsor

International student graduates who are unable to live in the NT for six months after completing two years of study in the NT will only be considered for a subclass 491 nomination. You must provide evidence of making genuine efforts to obtain employment** from an NT employer in their nominated occupation or a closely related skilled occupation.

You will be expected to demonstrate genuine efforts and progress towards being employed in the NT in your nominated occupation both during and after your studies. These applications will be considered on a case-by-case basis.

OTHER NT RESIDENTS

NT resident applicants will be considered for a subclass 491 nomination if you meet the following requirements:

  • applicants who started living in the NT prior to 1 July 2020, must:

    • demonstrate that you have been residing in the NT for at least six consecutive months immediately prior to application

    • demonstrate that none of your migrating dependants are residing in another part of Australia, and

    • demonstrate full-time employment in the NT in an eligible occupation for at least six consecutive months immediately prior to applying for NT nomination and demonstrate the employment is available for at least a further 12 months.

  • applicants who start living in the NT on or after 1 July 2020, must:

    • demonstrate that you have been residing in the NT for at least 12 consecutive months

    • demonstrate that none of your migrating dependants are residing in another part of Australia, and

    • demonstrate full-time employment in the NT in an eligible occupation for at least six consecutive months immediately prior to applying for NT nomination and demonstrate that the employment is available for at least a further 12 months.

Q&A

Q1. If I have applied for a 485 work visa and completed a two-year Master of Accountancy degree in the Northern Territory while holding a 485 work visa, and applied for a 408 visa with full-time work authorization after graduation, will I have the opportunity to apply for the 190 state nominated?

A. THIS YEAR, THE NORTHERN TERRITORY GOVERNMENT CHANGED THE CONDITION OF HOLDING A FULL-TIME WORK VISA TO A 485 BRIDGING OR 485 VISA; 408 VISA IS NOT IN THE SCOPE OF CONSIDERATION, SO YOU MAY AS WELL SWITCH TO TRY FOR 491.

 

Q2. If I have completed two years of full-time study in the Northern Territory, but have not yet completed the course I am currently enrolled in, can I be nominated?

A. IN THIS CASE, YOU WILL NOT BE NOMINATED. THE NORTHERN TERRITORY STATE NOMINATION POLICY IS NOT TO NOMINATE CURRENT STUDENTS, YOU NEED TO COMPLETE THE CURRENT COURSE BEFORE YOU CAN SUBMIT THE NORTHERN TERRITORY STATE NOMINATED APPLICATION.

NOTE: It is important that if you are about to complete two years of study in the Northern Territory and your current visa is not valid long enough for you to wait for a state nomination invitation, DO NOT use your student visa to extend your visa! You can choose to renew your 408 COVID-19 visa or 600 tourist visa. Otherwise the Northern Territory government will require you to complete a new course before you submit a state sponsorship.

 

Q3. If I graduated from the Northern Territory but did not study in the Northern Territory for the full two years, am I eligible for a Northern Territory nomination?

A. NO, YOU MAY NOT. NORTHERN TERRITORY GRADUATES ARE ONLY ELIGIBLE FOR NOMINATION IF THEY HAVE COMPLETED TWO YEARS OF STUDY IN NT.

 

Q4. For Northern Territory graduates nomination, there is a requirement to demonstrate employability. However, in remote areas like Darwin it is difficult to find work in your nominated occupation, is there any other ways to demonstrate my employability?

A.THE NORTHERN TERRITORY GOVERNMENT IS RELATIVELY FLEXIBLE ABOUT WHETHER LOCAL GRADUATES CAN SUBSTANTIALLY WORK IN THE NOMINATED OCCUPATION.
GENERALLY, YOU ONLY NEED TO PROVIDE PROOF THAT YOU ARE TRYING HARD TO FIND A JOB, MAINLY INCLUDING YOUR RECORD OF APPLYING FOR RELEVANT JOBS, EMAILS FROM HR INVITING INTERVIEWS, OR EVEN EMAILS FROM YOUR APPLICATION BEING DECLINED BY HR, ETC.
IF YOUR MAJOR IS ACCOUNTING, YOU CAN APPLY FOR JOBS NOT ONLY FOR ACCOUNTING POSITIONS, SUCH AS BANK TELLERS, CASHIERS, PAYROLL AND BENEFITS, AND OTHER POSITIONS RELATED TO ACCOUNTING.

 

Q5. What is the definition of full time for the purpose of the Northern Territory Government nomination?

A. THE NORTHERN TERRITORY DEFINITION OF FULL-TIME WORK IS AT LEAST 35 HOURS PER WEEK, WHICH IS SLIGHTLY DIFFERENT FROM THE EMPLOYER-SPONSORED DEFINITION OF FULL-TIME WORK OF NOT LESS THAN 38 HOURS PER WEEK.

Q6. If I want to be considered for both 190 and 491 nominations, do I need to file separate state nomination applications?

A.THERE IS NO NEED TO FILE SEPARATELY. IF YOU SUBMIT A 190 NOMINATION APPLICATION BUT ARE FOUND INELIGIBLE BY THE NORTHERN TERRITORY GOVERNMENT, THE NORTHERN TERRITORY WILL CONSIDER YOUR 491 NOMINATION APPLICATION.

Q7. Is the invitation to the Northern Territory passive or active? Will the invitation preferences be selected based on higher scores, or will they be approved based on the time of submission?

A.THE NORTHERN TERRITORY STATE NOMINATION INVITATION IS ACTIVE INVITATION, WHICH MEANS YOU CAN SUBMIT YOUR STATE GUARANTEE APPLICATION DIRECTLY AFTER MEETING THE STATE GUARANTEE REQUIREMENTS.
THE NT STATE NOMINATION ONLY NEEDS TO MEET EOI SCORE OF 65, AND DOES NOT GIVE PRIORITY TO INVITE HIGHER SCORES, THE APPROVAL IS MAINLY BASED ON THE SUBMISSION TIME, SO TRY TO SUBMIT ASAP!

Eligibility and Important Information

To be eligible to apply for state nomination, you must meet the following requirements set out by the Department of Home Affairs. You must have:

  • Not yet turned 45 years of age

  • Nominated an occupation on the relevant list of eligible skilled occupations

  • A valid and positive skills assessment for your nominated occupation

  • At least ‘Competent’ English language proficiency

  • At least 65 points on the Department of Home Affairs points test.

MIGRATION TASMANIA – IMPORTANT INFORMATION

Meeting the minimum nomination requirements does not guarantee that you will be offered state nomination from the Tasmanian Government. The Department of Home Affairs sets a nomination quota for the state each year, which limits the number of applicants that can be nominated.

If you are able to meet the minimum nomination requirements, your application will be competitively assessed against other eligible applications, with a focus on your ability to address a number of criteria, including:

  • the demand for your particular skills and expertise, and your prospects for finding skilled employment in Tasmania

  • your demonstrated ability and commitment to establishing yourself, and any dependents, in Tasmania with a view to your prospects for long-term settlement in the state

  • the relevance of your qualifications, skills, experience and capabilities – to the needs of Tasmania’s labour market

  • the skills and background of dependent family members

  • your level of English language competency

MULTIPLE NOMINATIONS

Applicants nominated for a Subclass 491 Skilled Work Regional (Provisional) visa will not be able reapply for a Subclass 190 in the future. The Subclass 491 visa provides a pathway to permanent residency by way of a Subclass 191 visa. Previous state nominees supported for a Subclass 489 visa will need to follow the pathway to permanent residency by way of the Subclass 887 visa.
