Hays Migration is a registered migration agency and education consultancy headquartered in Adelaide, South Australia, with branch offices in Melbourne, Hobart, Darwin, and Qingdao (China). We operate in Australia as a registered migration agent under the Migration Act 1958 (Cth) and in New Zealand as a licensed immigration adviser under the Immigration Advisers Licensing Act 2007 (NZ).
2. Regulatory Status and Professional Obligations
2.1 Australian Migration Services
Hays Migration provides migration assistance in Australia through agents who are registered with the Office of the Migration Agents Registration Authority (OMARA). Our Australian MARA registration number is 1169782. You may verify this registration on the OMARA public register at www.omara.gov.au.
All migration assistance provided by Hays Migration is subject to the Migration Agents Code of Conduct (“the Code”) made under the Migration Agents Regulations 1998 (Cth). The Code governs the standard of conduct required of our agents and sets out your rights as a client.
2.2 New Zealand Immigration Advisory Services
For New Zealand immigration services, Hays Migration operates as a licensed immigration adviser. Our New Zealand Immigration Advisers Authority (IAA) licence number is 202506270. You may verify this licence on the IAA public register at www.iaa.govt.nz.
New Zealand immigration advice is provided in accordance with the Immigration Advisers Licensing Act 2007 (NZ) and the Code of Conduct issued thereunder.
2.3 Education Services
Hays Migration also provides education consulting services, including assistance with enrolment in Australian and New Zealand educational institutions. Our education agents hold QEAC (Qualified Education Agent Counsellor) certification where applicable. Education agency services are provided in accordance with the ICEF Agent Assessment Program standards and applicable national codes for international student recruitment.
2.4 Legal Partnership
For complex migration and legal matters, Hays Migration works in partnership with Northan Legal, an Australian law firm. Where a matter requires legal representation or advice beyond the scope of registered migration assistance, clients may be referred to Northan Legal. Any such referral will be disclosed to you in advance.

4. Eligibility to Use This Website

5. Client Services Agreement
These Website Terms and Conditions govern your use of the Website only. They do not constitute a client services agreement for migration or education services. Before Hays Migration provides you with migration assistance or education consulting services, we will provide you with a separate written Client Services Agreement that sets out:
- The specific services to be provided;
- Our fees and disbursements;
- Our refund policy;
- Your rights and obligations; and
- Complaints and dispute resolution procedures.
The Code requires us to provide you with a written agreement before commencing migration assistance. If you engage Hays Migration for migration services and have not received a Client Services Agreement, please contact us immediately at info@haysmigration.com.
6. Your Rights and Complaints
6.1 Australian Migration Services — OMARA
If you are dissatisfied with the migration services provided by Hays Migration in Australia, you have the right to make a complaint to OMARA. OMARA investigates complaints about registered migration agents and can take disciplinary action including cancellation or suspension of registration. You may contact OMARA at:

Making a complaint to OMARA does not affect any other rights you may have, including under the Australian Consumer Law.

6.3 Internal Complaints

7. Consent to Contact and Marketing
7.1 Service Communications

7.2 Marketing Communications

8. Disclaimers and Limitation of Liability

8.3 Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other applicable consumer protection law that cannot lawfully be excluded. Where Hays Migration is liable for a failure to comply with a consumer guarantee, our liability is limited to (at our election):
- Supplying the services again; or
- Paying the cost of having the services supplied again.
8.4 Limitation of Liability
Subject to clause 8.3, to the maximum extent permitted by law, Hays Migration’s total aggregate liability to you for any loss or damage arising out of or in connection with these Terms or your use of the Website shall not exceed the amount of fees actually paid by you to Hays Migration for the specific service giving rise to the claim. Where no fees have been paid (for example, for general information accessed through the Website), our liability is limited to AUD $100.
This limitation does not apply to liability arising from fraud, wilful misconduct, or any liability that cannot be limited by law.
8.5 Consequential Loss
To the maximum extent permitted by law, Hays Migration is not liable for any indirect, incidental, special, consequential, or exemplary damages, including loss of profits, loss of data, loss of goodwill, visa refusals, or other intangible losses, arising from your use of the Website or reliance on any content contained on it.
